Commission authorizes counsel to defend agency in Rodriguez lawsuit alleging open‑meeting violations

The Nevada Commission on Ethics voted Oct. 16 to authorize Commission Counsel to defend the agency and all named parties in Rodriguez v. Nevada Commission on Ethics, case number CV24‑02169 in the 2nd Judicial District Court.
Commission Counsel Bassett said the complaint seeks to prevent the commission from proceeding with an appeal, alleging the authority to file the appeal violated the open‑meeting law. Bassett told commissioners: "The complaint has been filed in the 2nd Judicial District Court ... and I'm requesting authority from the commission to defend it and all the named parties in that district court action." The counsel asked the commission to authorize defense and to allow counsel to file appropriate motions.
The commission voted to grant counsel authority to defend the commission, commissioners and executive director and delegated authority to the chair and vice chair to consult with counsel regarding legal issues or decisions pursuant to the cited statutes and administrative code, but it required that any agreements to dismiss or settle be brought back to the full commission.
The motion was recorded as carried by unanimous vote. Counsel was directed to return to the commission with any decisions such as dismissals or stipulations for full‑commission approval.
