Council authorizes notice and forms subcommittee for contractor nondiscrimination rule updates

Adam Romero presented proposed updates to contractor nondiscrimination and compliance regulations (Attachment C), explaining the changes are intended to clarify existing law governing state contractors and to reflect obligations under the Fair Employment and Housing Act and Government Code Section 12990.

Romero said the modifications would reiterate existing employer obligations — for example, employers with five or more employees must provide harassment prevention training every two years — and would place clearer language in state contract terms so contractors understand their legal duties.

The council moved to form a subcommittee to work with department staff on the drafting and to authorize the department to notice the proposed modifications for a 45‑day public comment period. The motion and the follow‑on vote to approve the 45‑day period passed on unanimous roll calls. Councilmembers volunteered to staff the subcommittee and the council confirmed the appointments by roll call.

Staff said the rule text reflects existing law and the department will lead most drafting tasks, with the subcommittee providing guidance. The council also discussed logistics for collaboration with the Commission on the State of Hate, public forums and posting forum materials and video online.

The formal notice will include the opening and closing dates for the comment period and instructions for submitting comments to be included in the formal rulemaking record.
