Health department proposes harmonizing Lincoln food code with Nebraska’s 2022 FDA Food Code

Justin Daniel, supervisor of the food safety program at the Lincoln Lancaster County Health Department, told the council the Nebraska Legislature adopted the 2022 FDA Food Code through LB 245 and that the proposed local amendments would harmonize the Lincoln Food Code with state law.
Key changes include aligning the locally issued food protection manager permit expiration with nationally accredited food-protection-manager certifications (extending the local permit from three to five years to match national certificates) and removing a local section on preventing contamination from hands because that requirement now exists in state law. Daniel said the local health department already requires an accredited food-protection-manager certification but proposed adjustments to reduce confusion by making local permit expiration dates and statutory references consistent with the state code.
Daniel said the revisions also clean up cross-references for cottage foods and farmers-market products and that the changes were reviewed by the Health Department’s Food Advisory Committee and the Board of Health. The council heard no public comment on the item and proceeded.
