Walton County commissioners recess to executive session to discuss ROC Interest LLC lawsuit

The Walton County Board of County Commissioners recessed its Nov. 24, 2025, special meeting into an executive session to consult with the county’s attorneys on litigation strategy in ROC Interest LLC v. Walton County, case no. 2025 CA 411, county attorneys said.
County attorney Clay Atkinson told the board the session would be held under Florida law and recorded by a court reporter. “This time, I would like to request that we adjourn to executive session ... ROC Interest LLC versus Walton County, Walton County Circuit Court case number 20 25 c a 4 1 1,” Atkinson said, adding that “the entire session will be recorded by a court reporter and a transcript will be filed with the county clerk made available to the public at the conclusion of the litigation discussed here and today.”
Atkinson cited the statutory authority for the closed meeting, referring to Section 286.011(8) of Florida law, which permits governmental bodies to meet privately with their attorneys to discuss pending litigation. He also listed the participants who would attend the executive session: assistant county attorneys Matthew Richardson and Frankie White, himself, and county administrator Brian Kellenberger.
Before the board recessed, commissioners identified their seats for the record: Tony Anderson (District 5), Danny Glindwell (District 2), Dan Curry (District 1) and Donna Johns (District 4). A motion to recess to executive session was made, seconded and approved after the chair called for the vote.
The board reconvened in public at 12:04 p.m. After brief closing business, a motion to adjourn carried and the meeting ended.
No substantive details of the litigation strategy or legal positions were released during the public portions of the meeting. County attorneys said the transcript of the executive session will be made public when the litigation is resolved.
The board met at the South Walton Annex. The county attorney estimated the executive session would take approximately 30 minutes.
Next steps: the transcript of the executive session will be filed with the county clerk and made available to the public at the conclusion of ROC Interest LLC v. Walton County, per the county attorney’s statement.
