Town of Mooresville planning staff on Dec. 1 presented a conditional rezoning and a concurrent voluntary annexation request for Brentwood Phase 5, an 86-acre development proposal that would add 111 single-family homes at 41 Black Angus Road.
James Coley, planning staff, said the project seeks to change zoning from RLS to conditional residential to permit the single-family homes, with a proposed density of 1.3 units per acre, 27.8 acres of open space and two significant stream buffers. Coley noted the owner as R Mitchell and Bradley Hager and the applicant as AMH and Bowman. He said staff has found the map and amendment standards have been met but the planning board unanimously recommended denial on Aug. 26, 2025. "Brentwood Phase 5 is a conditional rezoning to allow for a 111 single family homes," Coley said in the meeting.
The board’s discussion focused heavily on traffic and road connections. Coley told the board a signal-warrant analysis for the Faith and Shears intersection "did show that there was not a signal required at this time." An unidentified staff member explained the analysis looks for an eight-hour period of need and that the study showed only two to three peak hours meeting the warrant. Commissioners pointed to nearby projects that required major road improvements and asked staff to flag the Faith/Shears intersection and present potential mitigation options for the public hearing.
On annexation and utilities, Coley said the annexation request (X2508) is voluntary and contiguous, and that water and sewer are available; police and public works indicated the site can be served. Staff said the project would be in Ward 1 if annexed and that the site lies within the town’s five-mile coverage area and adjacent to a preferred four-minute response window.
The item is scheduled as a public hearing at the board’s upcoming meeting. Commissioners asked staff to provide additional traffic detail, suggested potential conditions (such as turn-lane or signal triggers and specific road improvements), and to compile a clear list of conditions to negotiate with the applicant. No formal vote on the rezoning or annexation was taken during the pre-agenda session.
The board previously discussed related phases; Coley said the total number of units across phases would be 347 including the proposed phase. The public hearing will allow resident comment and give the board the opportunity to consider conditions tied to traffic, hours, buffers and other mitigations.
