Council approves pickup‑lane and late‑hours permits for Marco’s Pizza site on China Spring Road with conditions

The council approved two related special permits for a proposed Marco’s Pizza and small office at 12400 China Spring Road after staff and the applicant discussed conditions intended to reduce impacts on the adjacent single‑family neighborhood.

Clint Peters of the planning department summarized that the planning commission had recommended disapproval of a full drive‑through but provided alternate findings and conditions for approval of a pickup lane and extended hours. The staff‑recommended conditions include directing site lighting toward the building, installing and maintaining a privacy fence along the property line with the adjacent single‑family lot, restricting the drive‑through lane to pickup orders (ordering may not occur in the lane), prohibiting issuance of permits for a menu board serving the lane, and limiting the permit’s validity to 12 months after a certificate of occupancy (or two years from permit issuance, whichever is first).

Proponent Jane Kittner (Kitner in an earlier packet notation) and franchisee Robert Mach described site measures — a preserved tree line, fence, and limited queueing — intended to buffer the single adjacent notified residence. Council members asked staff to confirm distances, the single notified residence, and whether a supermajority vote was required given planning commission disapproval; the city attorney said recent state law changes removed the supermajority requirement. Council moved and approved the permits with staff recommendations on roll call.
