The Brentwood Select Board voted 4–1 on Nov. 18 to accept Tanya Lane as a town road, despite planning‑board findings that several driveway culverts were built with PVC rather than the concrete required by town ordinance.
Barry Geier of Jones and Beach Engineers, representing the developer, described the subdivision (about 13 lots) and the construction timeline. He told the board the planning board and the town engineer inspected the road and concluded the existing culverts would not undermine long‑term drainage or degrade the roadway. "In your package...there is a letter from the road agent indicating that the town does not maintain driveway culverts. It's the homeowner's responsibility," Geier said.
Planning board member Doug Marino said the planning board recommended release of the bond and that homeowners would receive written notice that the PVC culverts do not meet town standards. Board members discussed whether acceptance would set a precedent; engineering staff and developer counsel said the planning board would notify homeowners and that future developments should meet current specifications.
The board adopted the motion to accept Tanya Lane as a town road, with one member voting against acceptance because of concerns about the culvert construction and the precedent it might set. The board directed staff and the planning board to draft homeowner notices, to consider post‑construction driveway inspection protocols, and to review the driveway‑permit fee structure for possible amendment.
