Park County approves third amendment to Good SUP 227, allowing 15 additional storage containers with conditions

Park County commissioners approved a third amendment to Special Use Permit (SUP) 227 for Chris and Mara Good to add 15 storage containers to an existing fireworks storage and distribution operation.

Planning staff summarized the property history and prior SUP actions: the original SUP was approved on March 15, 2022 for fireworks storage and distribution with up to 40 containers; a March 2024 amendment added a 4,800 sq ft equipment building and a June 2025 amendment added another 1,200 sq ft building. Staff noted the site is in the rural Powell zoning district and that the use is recognized as a major wholesale business; neighboring properties are primarily residential and agricultural. The packet listed agency responses including a current tax status from the Park County treasurer, WYDOT confirmation the access is permitted, and Park County Fire District Number 1's willingness to provide fire suppression if access is constructed to accommodate apparatus.

Staff recommended adding a single additional condition to carry forward: "The applicant shall obtain an approved building/zoning permit for each storage container used to store fireworks on the property prior to placement." Staff also reiterated existing conditions carried forward from the previous amendments, including setback requirements (minimum 50 feet from the right‑of‑way and 50 feet from residential structures), compliance with state and federal storage and safety requirements (including ATF, NFPA and OSHA as applicable), and a prohibition on storefront retail and public demonstrations: "The applicant shall not store, distribute, or launch/demonstrate/display fireworks on the property for the general public."

Applicant Chris Good asked the board to remove the restriction on public displays, saying he wanted flexibility to permit certain events; commissioners and staff clarified the condition was intended to allow private distributor activity while preventing general public fireworks displays for safety and traffic reasons. Good asked whether future expansions or additional containers could be added without returning to the board; staff advised that an expansion that exceeded site‑plan thresholds (5,000 sq ft floor area or one acre of impact) would likely trigger a new SUP or site plan review, and that the applicant could submit a new SUP if he preferred to seek broader expansion authority.

After public input closed with no additional comments, a commissioner moved to approve the Good SUP 227 third amendment with staff recommendations; the motion was seconded and passed by voice vote. The board recorded the approval as Resolution 2025‑80.
