Attorney Thomas Lynch, representing 40 South Broad LLC, described the application as “the front end of a process” and said the building would provide 11 residential units and three commercial units while preserving the eight public parking spaces recorded in an easement to the City (Vol. 1004, p. 240 of the Milford land records).
City Attorney John Bircham told the commission the city’s interest is to preserve the parking and that the project “seems consistent with MCDD and transit oriented development,” while noting a temporary disruption to parking during about six months of construction. Bircham said the parking easement remains the city’s responsibility whether the specific project proceeds or changes course.
Commissioner Itan Hirsch moved to refer the application pursuant to Conn. Gen. Stat. §8‑24; Commissioner Mortimer seconded. The roll call vote recorded the commissioners present as supporting the referral and the motion passed. Lynch indicated that if the Board of Aldermen approves the §8‑24 referral, the applicant will return to the Planning & Zoning Commission with a site plan application.
