TCEQ adopts enforcement docket and receives monthly enforcement report showing $4.55M assessed so far in FY2026

The Texas Commission on Environmental Quality adopted enforcement items 10 through 22 as recommended by the Executive Director and received its monthly enforcement report for fiscal year 2026 through September.
Megan Hamilton of the Enforcement Division presented items 10–22. She said the total assessed administrative penalties in the docket were $456,005 with $82,507 deferred; $91,113 applied toward supplemental environmental projects and $282,385 directed to general revenue. Hamilton also presented the monthly enforcement statistics: 181 effective administrative orders (22 with SEPs) totaling $4,554,251 assessed and $2,457,620 payable; 1,258 notices of violation issued; 132 enforcement action referrals; 3,260 pending administrative orders with 1,447 on backlog; and 164 cases pending at the attorney general’s office for representation.
OPIC reviewed and supported the enforcement items; commissioners thanked enforcement staff for their work and adopted items 10–22 as recommended. The monthly report was received for informational purposes; commissioners did not take further action on the report during the meeting.
The commission noted the new leadership in the enforcement area and congratulated staff but made no substantive policy changes during the session.
