The Leavenworth County Board of Commissioners was told that Kaw Valley requested a postponement of its pending matter until February so the applicant can further consider public comments.
The county counselor said the request came from the applicant and therefore the county cannot unilaterally delay the matter. "This is a due process issue," the county counselor said, adding that because the request was made by the applicant and the public hearing has concluded, no additional notice requirements are needed and the item will be posted on a future February agenda.
The board acknowledged the request and no motion was required; commissioners reported no objections to honoring the applicant's request.
What happens next: the item will not appear on next week's agenda and will be scheduled for February for further consideration following the applicant's outreach to address public comments.
