Commerce City Council adopted Resolution 2025‑087 on Nov. 17, determining that a five‑parcel, approximately 35.01‑acre property located at the southeast corner of East 104th Avenue and Brighton Road meets Colorado statutory requirements for annexation eligibility.
City planner Nathan Chavez told council the site lies within the city's urban growth boundary, meets contiguity requirements and is serviceable by existing city roads, utilities and the local fire district. Chavez said both Adams‑14 and 27J school districts submitted letters indicating no anticipated student generation from the site and that the parcels are under common ownership.
Chavez summarized the annexation process: substantial compliance (completed Oct. 6), eligibility (this hearing), and a future annexation ordinance and annexation‑zoning applications that will return to council after the annexation agreement and zoning reviews are finalized. Council asked for the record how long the city has been in conversation with the landowner; staff said a formal application was submitted in 2019 and withdrawn the same year, with the current application submitted in 2025 and informal contact dating back approximately six years.
With no public testimony signed up for this hearing, council moved to adopt the eligibility resolution. The clerk reported the measure passed with eight affirmative votes and one excused absence.
