Health department seeks local food-code edits to align with Nebraska adoption of 2022 FDA Food Code

Justin Daniel, supervisor of the Food Safety Program at the Lincoln-Lancaster County Health Department, presented proposed changes to Chapter 8.2 of the Lincoln Municipal Code to make the local food code consistent with Nebraska's adoption of the 2022 FDA Food Code.
Daniel said LB245 adopted most of the 2022 FDA Food Code into the Nebraska Pure Food Act and that Lincoln's code already contains similar requirements. Proposed local changes would harmonize expiration dates so locally issued food protection manager permits parallel the five-year validity of nationally accredited certifications and remove local bare-hand contact language now covered under state law. Daniel also said the department proposed cleanup language to cross-reference state rules for cottage foods and farmers market products.
Daniel said the Health Department's Food Advisory Committee and Board of Health had previously approved the changes and that staff held industry meetings to gather input. The council received the presentation with no public testimony on the item that evening.
