The Dickinson City Commission approved multiple land‑use items on Dec. 2 and tabled one rezone after staff determined a protest petition likely imposes a higher voting threshold.
Community development staff planner Natalie Birchak told commissioners she recommended approval of several applications. The commission approved the Dean Wanner final minor subdivision (about 40 acres), which the applicant said would split a parcel into two lots to gift a portion to a family member; the approval was recorded as Resolution 52‑25, 2025.
The commission also approved the 23rd Street edition final plat (about 1.88 acres), a replat combining multiple small lots to provide additional paved parking; staff said existing easements had been vacated, making the constructed buildings legally conforming if the plat were approved (Resolution 53‑2025).
In public hearings the commission approved zoning changes and a PUD amendment. Staff presented an amendment to the Saint Joe’s Plaza planned unit development (Ordinance 18‑41) that would formally permit restaurants and limited retail services on specified blocks and clarify that parking spaces on 7th Street West within the right‑of‑way remain public and will be maintained by the city (pavement repairs and striping). "These are uses that currently exist within Saint Joe's Plaza. This is just updating the PUD to make those ... permitted uses," Birchak said.
The commission also approved a zoning map amendment (Ordinance 18‑42) to rezone a small parcel from General Commercial to General Industrial (the Diamond First rezone) contingent on a related final plat, and approved a rezone request for Saks Motors (Ordinance 18‑43) from R‑3 (high‑density residential) to General Commercial with two staff conditions tied to a related final plat and a plat note restricting future administrative lot modifications.
One item was tabled: Dossinger told the commission that a protest petition and an appeal to the board of adjustments had been filed for the Wynn Heart River fourth rezone; he cited Section 62‑56(d)(3) and said the petition appears valid and would require a three‑fourths vote of those members elected to the commission for approval. Because Commissioner Bair was absent, Dossinger recommended tabling the matter, and the commission voted to table the rezone to the next meeting.
Next steps: The Wynn Heart River 4th rezone will be placed on the next Commission meeting agenda to allow a full board to consider the item. Other approvals take effect according to applicable plat/ordinance procedures and any recording or platting steps required by city staff.
