The Davenport City Council voted down a resolution to approve an agreement and release related to the estate of James W. Victor at its Dec. 10 meeting after a public commenter raised concerns about outstanding public records requests.
Judith Lee, identifying herself as from the 2nd Ward, told the council she had not received a response to her FOIA request and that her earlier comments about the matter still stood: "I just wanna say I have not received the response to my FOIA, which mirrored Alderman Newton's request as well." She urged the council not to put the city in jeopardy by ignoring potential legal obligations.
The resolution was moved and seconded. The clerk called the roll and the mayor announced that the resolution did not pass; the clerk reported the tally as seven no votes and two yes votes. No additional discussion or clarification of the FOIA response was recorded on the Dec. 10 record.
Because the resolution failed, no agreement or release was approved and no implementation or assignment of responsibilities was recorded during the meeting. Council members did not provide further comment on the specifics of the FOIA request or the substance of the proposed agreement during the public meeting.
