Council authorizes staff to pursue recovery after TIF developer defaults on public-improvement obligations

The council authorized staff on Nov. 17 to proceed with recovery steps after a developer failed to construct public improvements required under a tax-increment-financing (TIF) agreement for the Trax Maverick development.
City Finance Director reported staff had delivered a notice of default (one delivery confirmed). The developer’s representatives indicated they do not intend to continue construction of the remaining buildings or public improvements. Finance staff said the mechanism available is to add admitted assessments to recover taxes that were abated; the window to add an assessment for one of the years is closing and staff recommended moving forward promptly.
Why it matters: the city provided tax abatement under the TIF on the condition that public improvements would be completed; without the improvements the developer is not entitled to the abatement and the city seeks to recover the foregone tax revenue. Finance staff estimated there are assessments to recover dating to 2024 and 2025.
What’s next: council authorized staff to proceed with recovery if the default is not cured; if assessments become delinquent the county foreclosing process would apply.
