Davenport council votes to enter closed session to discuss litigation

On Nov. 25 the Davenport City Council voted unanimously to enter executive session to consult with legal counsel about pending litigation.
Council moved and seconded a motion “to go to executive session to discuss strategy with counsel and manners involving litigation pursuant to I code section 21.5.” Counsel advised that Iowa Code § 21.5 requires two-thirds of the full body to authorize a closed session and that the council had the necessary votes. A roll-call produced eight recorded 'yes' votes and the mayor announced the meeting would adjourn after the executive session and not return to the chamber.
Mister Huff (counsel) explained the quorum and vote threshold, saying the code requires two-thirds of the entire body to go into closed session. The meeting then proceeded to executive session as approved by council.
