Neighbors testified during the public hearing that an existing taco truck near the site already produces heavy alley traffic, late‑night patrons and sanitation issues. Jim Warner said the area’s alley now “feels like a street” and is saturated with similar vendors. Claudia Vicencio described safety concerns for children and said people associated with the nearby truck have urinated on private property; Denise Bowman and other residents described garbage, property‑maintenance problems and repeated late‑night activity tied to bars nearby. Several neighbors urged the commission to consider parking, trash management, porta‑potty availability and hours as part of the review.
Planning staff explained that, under current ordinance, a food truck may operate temporarily for up to 12 days per year without a conditional use permit; the applicant sought conditional use to operate more frequently. Commissioners noted there is no explicit city restriction on food‑truck hours under the existing code. Multiple commissioners said the location’s ongoing property‑condition issues and the absence of the property owner at the hearing were material concerns. One commissioner recommended the applicant find a different site.
The commission moved to deny the conditional use permit; the motion carried on a voice vote. Staff offered to meet with the applicant and the property owner to discuss mitigation options and next steps if the applicant chooses a different location.
