The Coffey County Commission voted to approve Resolution Number 2020Five-nine66 on Monday, vacating a portion of street within Jacobs Creek West, Inc., as requested by local property owners.
The public hearing opened at 10 a.m. on the petition to close the roadway. Gary Scott, who identified himself as the petitioner, said the closing was intended to prevent dumping and protect private land while maintaining access for neighboring property owner Mark Harris. "We're the ones that asked for the closing of that street," Scott said during public comment.
During discussion, Scott and other citizens noted a discrepancy between a private survey (conducted for Mark Harris) and the county's survey pins. Commissioners advised petitioners to have the private surveyor re-survey against county markers if questions remain and noted that the county's legal description and recorded pins would drive the vacation process. The commission explained that after passage a certified copy of the resolution would be filed with the register of deeds and appraiser, and that taxes on the vacated parcel would then be handled according to county procedure.
Commissioner Avondroff moved to approve the resolution; Commissioner Petersen seconded. The motion passed on an aye vote. The resolution’s text referenced KSA 50 eight-two 613 as the statute governing the vacation of the roadway on unincorporated land.
Petitioners were advised to discuss survey discrepancies with a surveyor and consult an attorney if needed before implementing changes to fences or property access. The commission closed the hearing and resumed regular session after the vote.
