During public comment, Jim Thomas, a Trophy Club resident and member of the Trophy Club Municipal Utility District #1 board, criticized a scrivener's error in the posted executive-session agenda that implied the MUD might be contemplating litigation. Thomas said the MUD's general manager had told the town manager the MUD had no desire to pursue legal action and that the transfer of the elevated storage tank was proceeding; he said the transfer is scheduled to be finalized in February 2026.
Council recessed to executive session under Texas Government Code provisions that permit attorney consultation on contemplated litigation (Section 551.071) and deliberation about conveyance of property (Section 551.072). On returning to open session, a council member moved and the council approved a motion "to direct the town attorney and town manager to continue the process of conveying the town's water tower and other water and sewer infrastructure as is, with all faults and with the understanding that existing leases remain active with the town as lessor until they terminate." The motion was seconded and passed by the council.
Separately, staff earlier had presented and the council approved a replat creating a separate lot to facilitate future conveyance of the gated water tower site (case RPD-25-001).
