TCEQ clears multiple permits, schedules MUD hearings, appoints advisory committee members and adopts enforcement orders

At its Nov. 19 meeting the Texas Commission on Environmental Quality acted on a number of permits, scheduling matters and administrative items in a single set of votes.
Scheduling and MUD petitions: Commissioners discussed petitions for several Williamson County municipal utility districts (Items 4–6), debated whether to take oral argument, and agreed to place the matters on the December 17, 2025 agenda so parties can present oral argument and provide additional briefing.
Permit renewals and new permits: The Commission denied requests for contested‑case hearings and granted renewal of the City of Abilene's TIPTEASE/TIPTEAS permit number WQ005213000 authorizing an annual average flow not to exceed 1,510,000 gallons per day. The Commission also granted a new TPDES permit for Mustang Springs Utility, LLC and Jaffee Interest LP (WQ001-652-4001) authorizing a final-phase wastewater discharge of 990,000 gallons per day, after hearing staff recommendations and noting one hearing-request withdrawal.
Appointments: The Commission approved a resolution appointing seven individuals to the Tax Relief for Pollution Control Property Advisory Committee for four‑year terms ending December 31, 2029. Nominees approved included industry representatives and appraisal-district and taxing-unit representatives.
Enforcement docket and report: The Commission adopted enforcement items 10 through 22 as recommended by ED staff; staff reported total assessed administrative penalties across those items of $456,005 with $82,507 deferred, $91,113 applied to supplemental environmental projects and $282,385 to general revenue. The staff also presented the monthly enforcement report (Item 23) for FY2026 through September: 181 effective administrative orders (22 with SEPs) assessed $4,554,251, payable amount $2,457,620, 1,258 notices of violation, 3,260 pending administrative orders with 1,447 backlog cases, and 164 cases pending at the Attorney General's office.
What happens next: The ED will implement permit issuances and scheduling directions, finalize advisory committee appointments, and track enforcement and compliance follow-ups as described in the staff reports.
