Planning staff presented two proposed text amendments to the Apex Unified Development Ordinance on July 14. The first would revise a driveway-location standard (section 8.30.4.e) to measure the required 20-foot driveway length from the ultimate right of way rather than from the current curb or back-of-sidewalk location. Staff explained "ultimate right of way" refers to the alignment and width intended at full buildout (for example, after future road widening) so that future right-of-way expansion does not render a legally built driveway noncompliant.
The second proposed change would adjust the maximum built-upon area percentage in the use table for the Neighborhood Business and TexFlex zoning districts from 65% to 70%. Staff said reviews of recent applications suggested the previous 65% number was inconsistent with similar uses and that 70% would better reflect common, built conditions and provide consistency in review.
Board members asked clarifying questions about the definition of "ultimate right of way" and whether the amendments would be voted on separately; staff explained the term and noted the board could vote on the amendments individually or together. The board voted to approve the UDO amendments and the motion carried unanimously. The changes will be processed through the adopted amendment and Town Council review process.
