Planning commission recommends conditional use for one Dolphin Run short‑term rental over residents’ objections

The Planning Commission on Nov. 12 recommended approval of a conditional use permit that would allow a three‑bedroom unit at Dolphin Run condominiums to operate as a short‑term rental.
Applicant Christina Kinley, appearing for owner Robert Mills, said the property would be professionally managed, operate in compliance with city rules and provide 24/7 local contact availability. Kinley said the owner intends the unit primarily for families visiting the oceanfront.
Neighbor Paul Murphy Vio spoke in opposition, saying residents at Dolphin Run prefer long‑term occupancy and that posted public notices around the building had been missing or defaced in the days before the hearing. Paul Murphy Vio urged the commission not to convert the building’s character to a resort model. Kinley replied that Dolphin Run’s board had signed the conditional use application and that 34 units were participating in Dolphin Run’s rental program when she previously managed the property; staff also noted there are 11 previously approved short‑term rental conditional-use permits in the overlay area.
Commissioner Plumlee noted community concerns but moved to approve the permit, saying the council created the overlay allowing short-term rentals and that prior approvals exist; the motion passed by recorded vote 10–0. The recommendation will be forwarded to City Council for final action.
