Plan Commission votes to deny rezoning request for Imperial Garden Restaurant site at University and Allen

At its Nov. 11 meeting the Middleton Plan Commission considered a zoning map amendment for the northeast corner of University Avenue and Allen Boulevard, the site of the Imperial Garden Restaurant. Staff recommended denial of rezoning the parcel to mixed-use (MU) based on the findings listed in the staff report.

Commissioner Bruce moved to recommend denial of the rezoning request, citing the findings of fact in the staff report; Commissioner Shaw seconded the motion. The chair called the question; commissioners voted 'Aye' and the motion carried, formally recommending denial of the rezoning request.

During the discussion, commissioners asked whether motions needed to list the specific findings of fact or whether referencing the staff report would suffice; staff advised either approach was acceptable and confirmed the relevant findings enumerated in discussion as 2, 3, 4, 6 and 7. With the motion adopted, the commission recorded the denial as its formal recommendation to the next reviewing body.
