Winnebago County approves agreement with Forest City to vacate alley, clear title for sale

County attorney Steve explained a proposed agreement so Winnebago County would pay for title work and accept a city ordinance vacating an alley and a two-foot strip of Central Street to correct an encroachment in the south half of Block 5, Rebecca A. Clark's addition in Forest City. The city held its hearing and scheduled its ordinance hearing for Dec. 1; the city recommended the transfer to clear title and enable a sale.
Steve said the deed to the county dated to 1933 and that the county-owned shed has occupied the alley for many decades. He recommended approving the agreement, noted he had been involved with title work, and said the agreement includes language that any conflict of interest is waived so he can proceed with the city work and the county closing. Trustees discussed legal descriptions and retention of certain garage parcels and asked staff to confirm the final legal descriptions and check the buyer's offer if needed.
Trustee Derby moved to approve the agreement with the City of Forest City to vacate the alley and the two-foot strip; the motion was seconded and passed by voice vote. Staff were directed to coordinate signatures, confirm legal descriptions and follow up with the county attorney and city contacts to complete the closing and recording.
