Special Magistrate John Van Laningham on Thursday entered a final violation for an after‑the‑fact permitting matter at 2290 Seminole Way and set a compliance date of Jan. 6, 2026. The magistrate said fines would begin Jan. 7 if the work is not brought into compliance.
Michael Hausman, the town’s code compliance manager, told the court the case involved an interior and exterior remodel for which some required permit documentation (values, notice of commencement and other paperwork) was missing. He said the owner had submitted additional documentation to the building department and the permit remained under review.
Owner Kent Loepker, sworn in and testifying, said he had recently filed the requested notice of commencement and an owner‑builder affidavit with Lee County and was "working with" the town to complete the process. "He's been working with me very well, and we just want to do the right thing," Loepker said of town staff.
The magistrate set a compliance date of Jan. 6, 2026; if the property is not in compliance by that date, the magistrate said fines of $250 per day will begin on Jan. 7 and processing costs of $250 will be assessed. The owner accepted the schedule and said he would continue to cooperate with the town to finalize permitting.
