Lafayette City staff asked the council Nov. 24 to grant an exception to encroachment and related fees for the Park Theatre renovation so saved costs would be applied to the building’s rehabilitation. Staff said the municipal code allows the council to make findings to waive those fees when a project provides significant communitywide benefit.
Council members discussed precedent and disclosures of potential conflicts. Councilmember (speaker 12) disclosed she serves as a non‑compensated board member of the Park Theatre Trust and said the city attorney concurred there was no conflict and she would participate in the discussion and vote. Staff confirmed the city previously contributed $500,000 toward purchase and rehabilitation of the theater.
After questions about scope and precedent and staff’s written findings, Councilmember (speaker 3) moved that the council find the Park Theatre renovation project qualifies for fee relief under Lafayette Municipal Code chapter 3-2 (section 3-205(b)-(c)) as a city-sponsored activity providing significant communitywide benefit. The motion passed on a unanimous voice vote.
