The request, submitted by Blue Magic LLC on behalf of a client identified in the packet as EFC of Utah, asks the county to execute a letter of approval related to development of an "off‑grid" data center. The judge and county attorney Matthew explained the letter does not relieve the developer of permits, inspections, or legal review: "This is not obligate to the county to grant any permits that are otherwise required under the law," Matthew said.
Commissioners discussed energy options that an off‑grid site might use — natural gas, solar, geothermal or hydrogen — and noted the county cannot withhold permit review if the applicant meets regulatory requirements. The court approved the execution of the letter at the commissioner's request, with counsel’s advice that the action is limited to a letter of consideration rather than any binding entitlement.
County staff said the letter is a common early step to acknowledge a developer’s interest while preserving standard permitting and review processes. No specific site, power plan or fiscal incentives were approved as part of the action.
