The Oklahoma County Planning Commission approved an amended planned unit development (PUD 2025-04) for a nonconforming building at the corner of Northwest 164th and North Rockwell Avenue after commissioners narrowed the list of permitted Commercial General uses.
Staff explained the structure had been operating as a gym (a nonconforming use under R-1 acreage residential zoning) and the applicant sought a PUD to bring the property into compliance and allow limited commercial activity. Because the building has been used in a commercial way for some years, the applicant and counsel argued that rezoning to a limited commercial PUD was compatible with surrounding industrial and commercial parcels.
During discussion, commissioners identified specific uses they wanted removed from the broad Commercial General listing. Commissioners and the applicant agreed to strike several categories, including medical cannabis dispensaries, liquor/package stores, certain heavy automotive and truck-stop uses, and casino-related uses. One commissioner said he would support the rezoning only if it could be limited to uses akin to the existing gym.
A procedural confusion during the first roll call recorded a single 'No' vote and prompted the body to reopen the item; after amendment and a second roll-call, the commission approved Item 11 "as amended." Staff confirmed that final building- and site-level compliance (parking, screening, lighting, fire and life-safety inspections) will be required before any change of use beyond the gym may occur, and the item will be forwarded to the Board of County Commissioners for final action.
The commission approved the amended PUD; staff and the applicant agreed to provide a final list of struck and retained uses for the BOCC packet.
