Board votes to vacate private alleyway crossing new homeowners’ septic field in Ivanhoe

At a public hearing on Nov. 25, the Wythe County Board of Supervisors voted unanimously to adopt an ordinance discontinuing and vacating a portion of a 12-foot private alley in the Ivanhoe Subdivision.
Ron Baludas, a recent purchaser of the property, told the board the undeveloped right-of-way crosses his septic field and that adjacent properties already have other access from Route 94 and a rear road, Painters Hill. He asked the board to discontinue the right-of-way to avoid interference with his septic system and to remove a redundant access that has not been used for about 20 years.
The chair read the required public-hearing notice under the Code of Virginia. The Planning Commission had recommended the vacation. The chair then entertained a motion; Mr. Terry moved to vacate the right-of-way, Mr. Burnet seconded, and the board conducted a roll-call vote. All members voted aye and the ordinance was approved.
The board did not record further conditions on the vacation in the meeting transcript. The board directed staff to proceed with the action recommended by the Planning Commission and ordered the administrative steps necessary to finalize the ordinance.
