The Keene Zoning Board of Adjustment voted to continue consideration of an extension request for a special exception at 147 Main Street to the board's November meeting after the applicant's new counsel asked for more time.
Staff said the applicant, represented by counsel from Bernstein Shore and Associates, requested the continuance to permit preparation and presentation at the November hearing. The special exception was originally granted on Aug. 7, 2023; staff warned that further delays beyond November are not recommended because special exceptions and variances generally expire after two years if not acted upon.
During discussion a board member said the applicant had a pattern of delays and that further continuances risked disrespecting the application process; the planner said the common outcome of denying a continuance would be that the applicant could move for a rehearing and the board might still be obliged to hear the case. The motion to continue carried 4-1, with one member opposing.
The continuance gives the applicant time to appear with their new representative at the next regular meeting on Nov. 3, 2025. If the applicant fails to act and the prior approval lapses, staff said the regulatory changes since the original approval could require a different remedy (for example, a variance) if the applicant seeks similar relief later.
