Jacksonville Beach's Board of Adjustment on an unspecified date approved a 3-foot side-yard setback in lieu of the 5-foot requirement for a property at 528 South 3rd Avenue, with the board adding a stipulation that the variance be tied to the existing structure.
Applicant Julianne Overbey, who identified herself as an architect and gave her address as 2452 Pullian Street, Jacksonville Beach 32250, told the board she bought the vacant, long-neglected property to preserve a one-story single-family home and to create a small, more-affordable three-bedroom, two-bath house. "I'm requesting 3 feet in lieu of 5 feet for the side setback," Overbey said. She described the property as having been vacant for about 15 years, with interior mold and no utilities when her family closed on it, and said the existing house sits three feet from the side lot line according to the survey.
During board questioning, Overbey said the proposed detached garage would meet the five-foot standard and that the requested three-foot variance applied to the primary house only. An unidentified board member moved to approve the variance "based on the substantial competent evidence presented in the staff report and all relevant testimony presented at this hearing," and later moved to amend the motion to attach the 3-foot side-yard setback to the existing structure. The mover stated, "I would like to make a motion to amend my previous motion to approve this variance, with the stipulation that the side yard setback of 3 feet in lieu of 5 feet be attached to the existing structure." The amendment was seconded and approved.
A roll call vote on the motion as amended recorded "Yes" from John Moreland, Matt Metz and Owen Curley; the presiding officer then announced the request had been approved as amended. The board referenced section 34-5.72 of the Jacksonville Beach land development code during its findings.
