Staff recommends rezoning Turkey Creek parcel to reduce variance needs; commission hears applicant

Town staff presented a request by Midtown Legal to rezone a parcel at 12232 Turkey Creek Road from Agricultural (A) to General Single Family Residential (R-2), saying the change would reduce the number of zoning variances required to subdivide the parcel in the future.
Staff explained that the property had effectively been split by an estate sale into two ownerships but remains a single legal parcel; the non-lakeside portion is roughly a little over 20,000 square feet while the lakeside portion is about 9,400 square feet. Under Agricultural zoning, the minimum lot size is five acres, which makes future subdivision nonconforming; rezoning to R-2 would align the parcel more closely with neighboring lots and narrow the set of variances that subdividers would need to pursue.
Dave Hall of Midtown Legal spoke for the non-lakeside owners and said he was authorized to express the lakeside owner's approval for rezoning. Commissioners asked about the history of the narrow lakeside strip and whether it had been underwater during the lake's creation; Hall said aerial imagery going back nearly a century shows land in that area and said the house has been on the site at least 30 years.
Staff said it will prepare a formal zoning map amendment and return a recommendation to the commission for the next meeting.
