Eaton County Treasurer Darris Reynett updated commissioners Dec. 17 on foreclosure proceeds and legal risks tied to recent and pending court decisions.
Reynett said the foreclosure fund currently holds approximately $2 million and that estimated pre‑Raphael claims (foreclosure sales from 2016–2019) total about $1.3 million, leaving roughly $700,000 available in that fund. She said a class-action administrator for Wayside Church is preparing to begin paying claims for prior-period proceeds. Separately, Reynett warned that Peng v. Isabelle County, a case expected to be considered by the U.S. Supreme Court next year, could change the calculation of surplus proceeds from using auction sale price to using fair-market value; if applied retroactively, that shift could multiply county liabilities and raise the total county exposure significantly.
Reynett emphasized these payouts would be made from the foreclosure fund and “does not affect the general fund.” She pledged to continue updating the board as claims are processed and as federal- and state-level legal developments unfold.
