A Leitchfield committee approved a motion to accept a contract that would terminate the gas contract between Brownsville and Leitchfield and transfer ownership of the Brownsville Gas System to Leitchfield, but the approval was contingent on staff and counsel reviewing documents that arrived the same day.
"That will actually terminate the gas contract that's between the city of Brownsville and the city of Litchfield, but transfer ownership of the Brownsville Gas System to the city of Litchfield," said Unidentified Speaker 2 during the presentation of the agreement drawn up by committee counsel.
Unidentified Speaker 3 told the committee that attachments should not be placed on the front of the contract and that the group had received a packet of Brownsville documents that counsel and staff had not yet had time to review. "We would approve this subject to our review of their... Brownsville gas documents that they are presenting us," Speaker 3 said.
Discussion to verify easements and engineering plans followed. Committee members noted the easements on record were in Brownsville's name and that staff would match engineering plans to easement records to ensure the transfer covers the system and hookups.
A motion to approve the contract "subject to their approval after they go through the paperwork and the documents that have been submitted today" was made by Unidentified Speaker 1, and the motion was seconded as recorded by the meeting as being seconded by Mr. Blaine. The committee voted in favor and approved the motion.
Committee counsel and staff indicated they will complete their review of the newly received Brownsville documents before executing the contract. During the discussion, Speaker 3 indicated the arrangement that "we just had Bob sign it and we give him the authorization tonight," referring to a designated signer after verification of the paperwork.
Next steps: staff and counsel will review the packet from Brownsville, confirm easement and engineering matches, and complete any required final authorizations before the transfer is executed.
