Kenai — The Kenai City Council on Nov. 19 enacted Ordinance 3492-2025, with an amendment from administration specifying the city’s insurance will cover the damaged guardrail repair costs less a $1,000 deductible.
The guardrail on Beaver Loop Road protects users of an adjacent bike path. At the public hearing, Vice Mayor Askin moved to insert a new whereas clause noting the damage is covered by city insurance with a $1,000 deductible and to amend Section 1 to use restitution from the insurer as the appropriation source.
City Manager Kevin Eubank told council the guardrail was struck by a motorist who was initially thought to be uninsured. After the ordinance’s drafting, the city’s insurer determined the damage was eligible for coverage. Eubank said the insurer will cover the repair costs minus the $1,000 deductible and may seek subrogation against the responsible individual.
Council approved the amendment and then enacted the ordinance by roll call; the clerk recorded seven 'yes' votes in favor of the amended ordinance.
The ordinance’s amendment shifts the funding source from a general fund balance appropriation to expected restitution from the insurer, reducing immediate reliance on city reserves. City staff indicated the city may still pursue restitution for the deductible from the responsible motorist.
