Advisory committee backs updates to practicum language, reviews physician-consult and location regs

Members of the Kansas Behavioral Sciences Regulatory Board's master's-level psychology advisory committee on Dec. 3 reviewed three regulations and made a formal recommendation for one of them.
After staff presented KAR 102-4-6 (academically supervised practicum), the committee agreed to recommend adding the term "internship" alongside "practicum" and to remove references to "face-to-face" and "on-site" supervision to acknowledge that supervision can occur via remote means such as videoconferencing. Assistant Director Leslie Allen had proposed the wording at an earlier meeting; Chair Dave Anderson and committee members voiced support and the advisory committee reached consensus to forward the recommended change to the board.
The committee also examined KAR 102-4-14, the regulation that implements a statute requiring licensees to "consult with the client's primary care physician or psychiatrist" when the client has symptoms of a mental disorder. Members raised concerns about the practical meaning of "consult" in school and community settings, whether the rule presumes a primary care physician exists, and whether the language is a carryover from older practice norms. Leslie Allen and other members recommended revisiting the regulation with statutory text in hand; the advisory committee made no recommendation for change at this meeting.
Finally, staff reviewed KAR 102-4-16 (services rendered to individuals located within the state), which clarifies licensure jurisdiction based on the client's location. Members reviewed the language and agreed there was no need for changes at this time.
The committee recorded its consensus recommendation on KAR 102-4-6 for the board's consideration; the other two regulations will be revisited as needed.
The advisory committee noted that any change that links to statute will require appropriate statutory review and that staff would bring comparisons and statutory text to future meetings.
