Albany County approves two-lot New Life Subdivision and grants variance from covenant requirement

The Albany County Board of Commissioners on Dec. 2 approved preliminary and final plat SD-02-25, the New Life Subdivision, and granted a requested variance from the county's covenant requirement.
County planning staff presented the proposal, saying, "The applicant is Matt Baumgarner" and that the owner is New Life Church. Staff reported the parcel is located at 32296 Highway 30 and is about 31.5 acres; the proposal would divide it into two lots, described in discussion as roughly 19.5 acres and 12 acres. Utilities proposed include individual wells and septic systems (staff said Lot 2 already has an existing septic system). Power service was listed as Carbon Power and fire protection by Albany County Fire District 1. Staff noted reviews from the Laramie Rivers Conservation District and Wyoming Game and Fish regarding drainage, floodplain fencing, and noxious/invasive vegetation, and said remaining engineering comments on the final plan had been addressed.
Staff told the board the applicant requested a variance from Albany County Planning and Subdivision Resolution chapter 5, section 2(b)(4), which requires a provider to create recorded covenants or other instruments binding subsequent owners. Planning and zoning had unanimously recommended approval of the variance and recommended the board approve the subdivision, adopting staff analysis and findings.
An on-record commissioner moved to approve the variance and later moved to approve the subdivision, adopting the staff report; both motions were seconded and the board voted in favor. The chair announced, "Motion carries." No members of the public spoke during the public hearing.
The board's action allows the applicant to proceed under the county's minor subdivision standards, subject to any remaining technical conditions in the staff report. The action was recorded as adopting and incorporating staff analysis, findings of fact, and conclusions of law as stated in the staff report.
The matter is concluded for this hearing; staff will implement recording and any final plat-recording steps required by county procedure.
