Columbia Gas easement language revised to allow joint maintenance with city

Engineering staff said Columbia Gas asked for language changes to an already-approved easement at 55 Sycamore Street to make maintenance a joint responsibility for the portion used by both the utility and the city; staff and city attorney do not object and will present a resolution next week.
Engineering staff told the mayor and council that Columbia Gas requested limited language changes to an access easement already approved in August so the utility's legal counsel would sign the document.
"What I didn't realize at the time is that Columbia Gas Operations approved that plan, but they had not actually given the easement to their legal counsel to review," Jim Bender said. He explained the requested edits do not change the location or size of the easement at 55 Sycamore Street but would make maintenance a joint responsibility for the portion that the city also uses as the driveway into the public works storage yard.
Bender said he and the city attorney reviewed the red-lined language and do not anticipate problems if the council approves the revision. Staff plans to present a resolution at the regular session next week to finalize the language and obtain Columbia Gas's signature.
No change to the easement footprint was proposed; the alteration is strictly contractual language to reflect shared maintenance obligations for the area the city and Columbia Gas both use.
Council members indicated informal agreement during the work session; no formal vote was taken Dec. 9.
