The Boise City Planning and Zoning Commission voted to deny a conditional‑use permit and recommend denial of a preliminary plat for a proposed seven‑lot residential subdivision at 2701 South Pond Street.
Staff told commissioners that the property lies within Airport Influence Area B1 and that the 65 DNL (day‑night noise level) contour crosses the site, creating compatibility concerns under FAA grant assurances and the city’s airport overlay. The planning team recommended denial, noting the parcel could be developed to four units under the codified 5‑units‑per‑acre limit without requiring a variance. "As such, the planning team recommends denial of all three applications," staff said during the presentation.
Applicant David Crawford of Centurion Engineers argued the project would add only two or three lots beyond what the base zoning could yield and said neighborhood meetings produced no objections. "We're asking essentially for 7, which is 2 or 3 additional lots," Crawford said, noting adjacent properties include higher densities to the south. Commissioners pressed staff and the applicant on whether additional sound‑mitigation measures were proposed; staff said the application did not include further mitigation beyond code requirements.
After deliberation about the tradeoffs between infill housing and airport compatibility, Commissioner Moore moved to deny the CUP and recommend denial of the preliminary plat based on the staff report. The motion passed on a roll‑call vote, 6 in favor and 2 opposed.
The planning commission’s denial is a final local decision for the CUP (appealable to City Council) and a recommendation to City Council on the subdivision phase. The applicant may revise plans and return, or pursue appeals and reconsideration pathways described in staff materials.
