Council votes to send proposed vape-shop density ordinance to staff and planning commission
Summary

Sheila Wilson (ASAP of Anderson) told the council that state law (cited in the meeting as "TCA 57 3 2 0 8") provides a zoning pathway the city could use to limit the density of specialty vape shops in Clinton. Wilson said the number of standalone vape/specialty shops in town was "up to 10 or 11 now" and said she counted "6 within a mile," arguing residents had asked for fewer vape stores.
Wilson and other council members discussed how other cities have used population-based density formulas (for example, two per 10,000 population in one cited city) so that the rule limits new entries over time rather than closing existing shops. She offered to provide a one-page summary of THC/delta distinctions for council and said shops will be required to have state licenses in January.
Councilman Dominguez moved and Councilman Queener seconded a motion to have staff draft an ordinance and refer it to the planning commission. The council then took a roll-call vote (Council member Queener, Foster, Harold, Gann, Hatmaker and Maines were recorded as voting "Yes"). The presiding official announced: "Zoning is approved for consideration," and the motion to send the draft ordinance to planning passed.
Next steps: staff will work with MTAS and the planning commission to draft and schedule the proposed density ordinance for planning commission review and eventual council consideration.
