San Luis Obispo City Council on Dec. 13 approved the abandonment of a six-foot-wide portion of Church Street adjacent to 1804 Oso Street to complete a previously approved surplus-property transfer and related environmental indemnity agreements tied to a private development.
Gabriel Munoz Morris, supervising civil engineer, reviewed the project's administrative history: the applicant's vesting tentative map and planning approvals date to 2009; a resolution of intent to abandon was adopted in 2009; a real property exchange agreement for nearby surplus property was approved in 2015 but the right-of-way abandonment was not completed then. The city required an environmental indemnity agreement for transfer of the surplus parcel because of its proximity to railroad property; the applicant's original lender would not sign in 2015, and the process paused. The applicant has since procured a new lender willing to sign, asked staff to complete outstanding steps, and completed on-site patio improvements that would be included in the transferred area.
Staff re-notified utility companies and confirmed no utilities would be affected by the narrow abandonment. If the council adopts the abandonment resolution, staff will record the resolution, have the applicant grant a temporary pedestrian-access easement over affected sidewalk areas until relocation improvements are completed, transfer the surplus property to the applicant per the previously approved exchange agreement, and record the environmental indemnity agreement.
Councilmember Francis moved to approve staff recommendations and Vice Mayor Shorzman seconded. The council approved the resolution of abandonment on roll call 4-0. Staff said the applicant plans to submit the next phase of development within six months.
