City council consolidates noise rules, removes outdated decibel standards

City Attorney Jerry Baker and staff presented changes that move duplicate language out of the zoning code and consolidate enforcement under Chapter 34. Baker said staff and the police department had tested decibel meters but found the results inconclusive for consistent enforcement, so the draft removes the numerical decibel provisions from the older code and favors a plainly audible standard while clarifying presumptions and affirmative defenses. Baker cautioned that noise regulation can implicate First Amendment protections and urged careful drafting and enforcement.
Council members discussed how the city might address future issues such as sound from data centers or battery storage facilities through land‑use conditions, specific use permits or health‑code provisions. The ordinance passed unanimously.
