The City of DeBary adopted Resolution 2025-24, making a contingent finding under Florida statutes and the upcoming 2025 Schimberg Center for Housing Studies report to elect not to exempt certain properties from ad valorem taxation under the Live Local Act.
City attorney read the resolution, which references section 196.1978, Florida Statutes, and the Schimberg report. The city manager described the action as the routine annual resolution tied to the Schimberg Center’s housing inventory findings. He said the Schimberg report will determine whether Volusia County (or parts of it) demonstrates an "overabundance of apartment complexes" that would affect eligibility for the Live Local Act’s 75% property tax exemption for certain multifamily developments.
If the Schimberg report indicates the county has an overabundance, the resolution elects to not exempt those particular apartment complexes from the 75% Live Local Act tax exemption while preserving other existing exemptions and establishing a contingent effective date and expiration per the resolution language.
Council member Papalardo moved to approve the resolution; the motion was seconded and carried by a unanimous recorded vote. No members of the public spoke on the item.
