Because a public commenter had raised concerns and staff noted litigation related to aspects of the conveyance, a commissioner moved that the discussion proceed in executive session under Texas Government Code §551.072 (real‑property deliberation). The commission retired to executive session and later returned to open session, where a motion to accept the transfer (amended to include legal approval) carried; one commissioner recorded an opposed vote on the final motion.
City staff said the transfer would allow the city to manage drainage and outfall facilities in the affected area; staff and the city attorney indicated that further legal review would be completed before final execution of documents.
