Legal report: board amends penalties, upholds a $10,000 civil penalty after reconsideration request

Legal staff outlined changes including case #2025047881 (penalty changed to $5,000) and case #2025043921 (penalty changed to $24,000). Additional reported edits included an increase of a civil penalty in one matter to $10,000 and the issuance of a letter of warning in another file. Staff also reported one matter that had been re-presented after an attorney requested reconsideration; the board rejected that request and opted to uphold a previously authorized $10,000 civil penalty. Staff asked permission to work with responding parties to finalize consent-order language where appropriate.
Board members moved to accept the legal report as amended and approved it by voice vote. A member also flagged one case to change status to litigation monitoring and that change was incorporated into the amended report.
Staff said they would negotiate final consent-order language with respondents and proceed with issuing updated penalty notices as authorized by the board’s vote.
