The Village of Fairfax council on June 21 adopted Ordinance 22-2021, approving an amendment to the development agreement with Regency Centers for Outlot 12 at Red Bank Village, located at the corner of Red Bank and Shannon Way.
Administrator told the council a revised site plan and a rendering of the proposed building were provided to members and that the ordinance package includes the amended development agreement prepared by staff. The package was reviewed by Regency Centers, and Administrator described the next steps after adoption as execution of the agreement by both parties and continuation of Regency’s negotiations toward a closing on the proposed development.
Council moved to suspend three readings; the suspension passed on a 5–1 roll call and the ordinance was then adopted by a 5–1 vote with Mister Kessel recorded as the single nay. The council recorded that the majority carried the measure and the ordinance was adopted.
The transcript does not include substantive debate or amendments to the agreement in the meeting record beyond questions invited by the Administrator; specific terms of the amended agreement (such as site plan changes, financial incentives, or performance conditions) were not read into the minutes at this meeting and are recorded as part of the ordinance package shown to council.
