Developer asks county to quitclaim historic Cloverdale street dedications to Royce City to clear title
Summary
Developer representatives said title research uncovered historic street dedications in the Cloverdale area that exist on record but not on the ground; they asked the county to quitclaim any county interest to Royce (Roy) City so the project can proceed, and staff advised the developer to have title and survey exhibits prepared for formal vacation and quitclaim action.

Representatives for a proposed Lowerdale/Cloverdale development told commissioners that title work revealed recorded street dedications that are not built on the ground and that those dedications cloud property title.
The developer asked the county to consider a quitclaim of any county interest in the streets to Royce (Roy) City so the parcel would lie fully inside the city's boundary and enable the city to approve the development. Staff and county counsel said the appropriate next step is for the developer's title company and surveyor to prepare legal descriptions and an exhibit showing the exact areas that may need to be vacated or quitclaimed so the county can verify records before any formal action.
Commissioner comments focused on access, trail crossings and safety: representatives said UTA has granted a crossing and Royce City plans a roundabout on 4000 South that staff said will be coordinated with trail realignment. Commissioners suggested conditions such as ensuring emergency access, coordinating trail design and confirming rights-of-way before a formal quitclaim or vacation is presented to the board.
Next steps: the developer will coordinate with their title company and surveyor and return to staff with precise descriptions for the county engineer and counsel to review; staff indicated the county is willing to consider a quitclaim if the chain of title supports it and proper documentation is provided.
