Corporation counsel: Yankee Peddler case on hold pending appeals-court disposition

Corporation counsel told the Torrington Board of Finance Dec. 16 that the Yankee Peddler property matter is paused while an appeals court decides whether a prior motion-termination ruling and stay apply; a motion to sell the property cannot be docketed until appeals-court action is resolved.
Corporation counsel updated the Board of Finance on the Yankee Peddler litigation, saying the matter is essentially at a standstill while the appeals court considers an appeal by Jason Hospitality.
Counsel explained that a motion to terminate was appealed to the appeals court and that an automatic stay is in place, which has created conflicting rulings at the trial-court level about whether the stay prevents further trial-court proceedings. Counsel said the town is waiting for the appeals court’s disposition. "Unfortunately, I don't have a time frame, but it's still with the appeals court," counsel said.
If the appeals court allows trial-court proceedings to resume, the next local step would be a motion to sell the property, which must be docketed once the court permits further action. No sale motion or other final action occurred during the Dec. 16 meeting.
