A majority of the Logan City Council voted Dec. 16 to rezone a 2.5‑acre parcel at 900 North and 200 West (the Hill Cubex / YABC building) from Mixed Residential (MR‑12) to Community Commercial, amending Ordinance 25‑23 on the council floor.
Staff planner Amy Egbert reviewed the request and the Planning Commission’s recommendation. Egbert told the council the parcel has a long history of mixed commercial and residential uses; planning staff and the commission had recommended denial of a full Commercial zoning designation because of the parcel’s proximity to established housing and the broad set of high‑intensity uses allowed under Commercial zoning. Egbert said community commercial had been discussed as the lower‑intensity alternative preferred by staff and commissioners.
Property owner Jonathan/Sean (owner testified at the hearing) told the council the building has functioned for decades with commercial uses and that the owner wants legal certainty to bring the site into full compliance. The owner described needing an 8‑foot fence and the practical barriers of repeatedly seeking conditional use permits for routine maintenance or modest expansions. He said the building’s size and economics make certain high‑intensity uses unlikely, and that a commercial designation better reflects the site’s historical use.
Council members expressed concern about the long‑term implications of a full Commercial zoning next to homes but acknowledged the Planning Commission’s findings and the owner’s hardship. After discussion, a councilmember moved to amend Ordinance 25‑23 to Community Commercial; the motion was seconded and, following debate, the council voted by voice to approve the ordinance as amended.
The council’s action resolves the property’s legally existing nonconforming status and allows some future changes without repeated conditional‑use processes; staff indicated an exhibit and ordinance text will be updated to reflect the council’s amendment.
